Was South Africa out of compliance with international trade agreements?
The USTR claims that the South African Medicines Act was too vague, because it didn’t spell out in the Act that it would reimburse patent holders. While patent lawyers argue that TRIPS doesn’t actually require reimbursement payments, the South African Government spelled out reimbursement policies in its laws governing its patent system.
