The Energy Commission may take action on items of business not appearing in the posted agenda only under either of the following two conditions: • Upon a determination by a two-thirds vote by the Commissioners, or, if less than two-thirds of the Commissioners are present, a unanimous vote of those present, that there exists a need to take immediate action and that the need for action came to the attention of the Energy Commission after the agenda was posted, or: • Upon a determination by a majority vote of the Commissioners that an emergency situation exists. • In such event the Energy Commission must call all newspapers, radio, and television stations that have requested notice and notify them of the emergency meeting at least an hour in advance.
