Under What Circumstances is An Arrest Made?
Usually a peace officer must obtain an arrest warrant before arresting someone. However, he may conduct an arrest if there is probable cause to believe a person committed a crime or if an offense is conducted in the presence of the officer. A magistrate may issue an arrest warrant using an affidavit made under oath establishing probable cause that the accused has committed a crime. This warrant allows a peace officer to detain the accused.
