Well, according to Stanford’s Falzone, this is a major case for the future of the fair-use doctrine. “One of the interesting things that have happened in fair-use law over the past decade or so is that its begun to recognize the organizational value that informational guides provide,” Falzone told the Law Blog. “And it’s recognized that tools that help organize information, without changing it, have significant fair use value.” Of course, Warner and Rowling don’t see it that way.
