This is a strategy question for which there is no simple answer. However, many of our clients have used Trial Behavior’s research results from a community survey, focus group or mock trial results to settle a case in their client’s favor. If the damages are over $1 million, the cost-benefit ratio of pre-settlement research can be very favorable. Conducting research while discovery is still open also has significant beneftis.
