If indeed the towing company damaged your car while towing it, their insurance would pay you for any damages they did, and your own insurance wouldn’t be involved except to help you collect. Your insurance wouldn’t be telling you that you can’t sue the towing company even if your claim was through your own company for some reason, so that makes no sense. As a general rule, if a vehicle is considered a total and there is a bank or other finance company involved, they get the settlement, not you. You aren’t entitled to the worth of the vehicle (which I can’t see as being $10,500) since the finance company, not you, is the legal owner. If they pay $10,500 for the finance company and you are still in debt, you are leaving something out. Why was your balance higher than the worth of the vehicle? Did you have GAP insurance in place?
