Tenancy condition or separate contract?

The advice in the ODPMs financial package suggests that in order to collect charges from tenants, particularly in sheltered housing, support should remain a tenancy condition. The issues for agency managed schemes in long term schemes This proposal raised a number of issues particularly for schemes managed by managing agents. Previous advice has been that if support is included in the tenancy agreement then this gives the landlord a liability for the support provided. This raised the question of whether this could mean that some RSLs would want to hold the Supporting People contract and opt for the fully sub-contracted model management agreement.
