Who is the insurance policyholder? Do you hold the insurance for your baby, or does the father? If the father holds the insurance (say, through his employer, which covers him and coverage is extended to his child), then he should be legally responsible for any copays, coinsurances, and/or deductibles that result from your son’s medical treatment. If the father is the policyholder, then he is basically in a contractual agreement with his health insurance company to pay any copays and deductibles (a.k.a. patient responsibility) in return for the insurance company paying for your son’s medical services. So he should be held financially liable for any costs not covered by the insurance. However, if you hold the insurance, you probably won’t be able to hold him legally responsible for any of your son’s medical bills until the child support order or a divorce decree is in effect. Ok, I’m in VA too. You said ‘mediator’ – so you went to mediation, and at that point, he agreed to help pay the bill, correct? Well, the mediator should have then forwarded everything you agreed on to the judge and the judge should have signed off on it. Did that happen? If so, then YES, he has to pay the bills. If not, I would wonder why the mediator didn’t send the paperwork over to the judge. My son’s father and I didn’t agree in mediation so we ended up going to court and having a guardian ad litem appointed to my son. I know what you are going thru.
