Yes. Maine cannot prevent the federal government from enforcing federal law. Maine can, however, decide not to add its own penalties for growing medical marijuana under certain regulated conditions. Under current state law, it is a state crime for others to grow marijuana for sick people under any circumstances. LD 1418 would remove the state penalties in certain tightly regulated circumstances. This is consistent with current Maine law, which recognizes the right to use medical marijuana in some cases even though the federal government does not.
