Situation with case law and the need to quote cases?
We are not teaching the intricacies of law but a basic understanding of it. It isnt necessary to refer to cases but the examiner may reward candidates if they do so. Candidates may support their answers with analysis referring to cases or examples but they do not need to write out the details of the case. It is the point of law that the case establishes that is important. (Although knowing the facts of cases can sometimes be helpful as some questions include scenarios based on well-known cases). We would not expect candidates to refer to section numbers of Acts. Candidates should substantiate their points with references or examples.
