Legally, she may choose anyone as she is the primary care giver. However, if in choosing her parents this will affect your visitation, it will have to be approved by the court as a new visitation plan will have to be established. She can also, if she chooses, have a temporary gaurdianship established naming you as the child’s gaurdian while she is gone, with a specific date of termination set in the agreement. That would mean that on that date, the child would be returned to her custody and the previous visitation schedule would be re-instated. I would say that your ex is just wanting you to write a statement to satisfy her own insecurities just in case you tried to take custody of the child. Also, depending on the state that you live in, most states would grant you temporary custody while your ex is away, before they would grant it to the grandparents, IF you decide that you want to get custody that is.
