There are two circumstances, each with a different response: (1) The employee is separated by RIF. The employee could remain in the PPP, receive severance pay, if entitled, and also be offered a job by the contractor under the right of first refusal provisions. If the employee accepts the position, he/she would be eligible to remain in PPP as well as continue to receive severance pay. However, keep in mind that the right of first refusal is only applicable if the employee remains on the rolls of the affected activity and is involuntarily (RIF) separated as a result of an A-76 decision to contract out the function. (2) The employee is offered a VSIP and agrees to voluntarily resign or retire, and the employee does not receive an official RIF notice. The employee is permitted to work for the contractor even if he/she voluntarily separates with a VSIP.
