If you were married during the time that your spouse did not file taxes, then you would both be responsible for the non payments. If you don’t file, then it’s tax evasion. It would be better if hubby filed the taxes for those years but didn’t include payment rather than to not file at all. You are not really entitled to a refund if you owe the IRS for past years. If you were not married then, you can file a joint return this year and include an ‘innocent spouse’ form so that you might get 1/2 the refund back if you are due a refund. Filing separate doesn’t really gain you anything in this situation. Falsifying your filing status would be considered tax fraud, so I would not follow that suggestion.
