Should a duty of care (negligence in common law) be owed to prevent suicide victims from succeeding?
In most states and countries, there is no general duty to rescue or to prevent suicide. The duty is imposed on some folks by virtue of a relationship. Thus one who created the hazard may have a duty to rescue. Special duties are imposed on those who get paid to protect, such as cops, firefighters, paramedics, etc. If the Australian court recognizes the possibility of such a duty, it will certainly not be the first court to rule that way.
