The biological father has rights to that child, its his child. Unless the “step father” can prove somehow that it is in the best interest of the child for him to be involved…he has no rights to that child. If the man is married to the child’s mother, then you must prove that he causes harm to the child in order to keep him away. If the mother involves him then he can be involved. The biological father needs to go to court, get a DNA test establishing his rights as the biological father of this child and get some level of shared custody with the woman. I don’t really think this is a question of morals, it is a question of blood relation and the laws regarding that.

He has rights!!!! The extent of his rights will be set out by the courts, unfortunately. If she has reconciled with her husband and the husband is willing to accept the baby, the court might take that into consideration and not remove it from a “stable” home, (in the case of successfully raised children, not in the case of the separation) to an unknown. Good luck to this gentleman. Morally, neither is right. Legally, the “parents’ of the child have the rights. Just to add…. I am heart broken for your friends. This si such a horrible situation and unfortunatly, if bio-dad is really bio-dad, he has rights. If he is, he will more than likely be given some rights but, as for taking baby out of a , now, stable household, he might not get anywhere. Good luck to them and thoughts and prayers are with them in this difficult situation.
