May 26, 2009: Yes. Rule 1002.f.(1) specifies that “all oil and gas locations are subject to the Best Management Practice requirements of Rule 1002.f(2),” and all producing facilities that have completed interim reclamation or have inactivated a CDPHE stormwater construction permit are required to be in compliance with 1002.f.(3) until final reclamation is achieved.
