If the two of you marry here, you can file an immigrant relative visa petition on behalf of your husband, and he can concurrently file his application for adjustment of status with the USCIS while remaining in the United States. He will need to be able to document his having entered on the visa waiver program (I-94W card, stamp in passport). There are other requirements as well. An important issue for the USCIS is whether your husband had the requisite “nonimmigrant” intent when he arrived in the United States. If you file the petition/adjustment of status application(an “immigrant” application) within 60 days of his entry, the USCIS may conclude that he committed fraud at the port of entry. Generally it is safe to marry and file the paperwork after the 60 days.
