Private purchase of used car. Is the deposit refundable?
If I heard your question correctly, The agreement was not to deposit the check until he checked out the car fax report. He did that on Tuesday and the car checked out? If that is correct then I would deposit the check. If you have any further questions on this please send me an e-mail. In my opinion from what you have said, you have satisfied your part of the agreement and may be able to keep the deposit. I always like to make them give me a deposit in cash then write them a receipt for the option to purchase the car through a certain date and make sure it states it is not refundable. In the end, it could end up in small claims court as the agreement is entirely verbal.
