No. Participation in the Section 8 Program is voluntary. An owner may terminate participation in the program for one unit, and continue participating for other units. This process is defined as “opting out”. When this happens, the tenant must be given 90-days notice (copy to the Housing Authority) AND the Housing Authority AND the Housing Authority will not execute a new contract for the subject unit for a period of three years.
