On what basis is Workers Compensation exempt from HIPAA?
Workers compensation programs are not classified as health insurance payers, healthcare providers, or clearinghouses. In general, the HIPAA Administrative Simplification provisions cover only these three categories of organizations. There ia a number of types of organizations that should likely have been covered under HIPAA, but Congress chose to target these three groups.
