On what basis does the BZA make its decision?
The BZA must evaluate the proposed plan against each of the standards listed in Article XV. If one or more of the standards are not met, this CAN (but not necessarily) be cause for denial of the conditional permit. Note that there are no specific numbers associated with the standards. The Commission felt this would be too restrictive and cause unneeded expense to regulate. Among the regulations noted above, such regulations often involve specific numbers, which the BZA can refer to in aiding its decision.
