Nullity Of A Void Marriage?
A void marriage is not recognized legally when between siblings, with someone who is already married or between family members or descendants such as uncle and niece and aunt and nephew. In these cases nullity can be awarded by the Supreme court to declare children legitimate, allow for equitable distribution, custody, maintenance and other procedures to continue as well as for the end of the marriage to be added to the public record. In a practical sense divorce, annulment and a declaration of nullity in a void marriage are the same thing, however an annulment and a declaration of nullity require a greater degree of proof before they will be awarded.
