Anyone wishing to present a wage scale at a Common Construction Wage hearing may do so, however there are a few statutory and legal requirements that must be met. Indiana Code 5-16-7-1 requires a Skilled, Semiskilled, and Unskilled rate be provided for each classification of labor presented. Subsequent case law (Union Township School Corporation v. State ex. rel. Joyce) also defines that an hourly “Fringe Benefit” should be adopted for each skill level, and that the wages must be configured using the mode. For more information concerning wage scale format, please email the Indiana Department of Labor at ccw@dol.in.gov or read our Guide to Establishing Indiana’s Common Construction Wage .
