My neighbour keeps burning rubbish in his garden can I stop him from doing so as it’s causing a nuisance?
There is no legislation that prevents people burning refuse on their own property. Some local authorities however have passed by-laws that apply to burning refuse in certain locations. If smoke from a bonfire is a persistent nuisance you should contact the environmental health department of your local authority who may be able to help. If fire causes damage to your property and it was pointed out to the neighbour that this may be the out come of his actions or he is recluse this may be classed as arson and legal proceedings could be taken.
