Since you have a copy of the mortgage contract then I would speak with a lawyer. What is written in the contract will hold up in a court of law. A lawyer can review the contract and contact the mortgage company to try and work it out without having to go to court. Depends on how the mortgage company reacts from speaking with the lawyer if it can be settled or if not  the case will go to court. Otherwise if you don’t speak with a lawyer you will have to pay what the mortgage company says or maybe you can talk to someone higher up who will try and resolve this problem without a lawyer.
