A. First of all, Kb is kilobits and KB is kilobytes. A connection rated at 384Kbps offers a speed of about 44KB/sec. So there is nothing wrong with your connection or the uploader. B. Sometimes your download speed will affect your upload when doing http uploads. For example, at my former college, everyone was given a download speed of about 90KB/sec and an upload of about 300KB/sec. Yes, they capped the downloadstream a lot lower than the upstream. Anyway, when using a HTTP uploader such as this, I could only upload as fast as 90KB/sec. Of course, using FTP allowed for the full 300KB/sec. Please note this scenario is very rare.
