My employee does not make enough to withhold as much as the Order to Withhold Income requires every month. Must I send the entire paycheck as child support?
A. As stated in the Income Withholding – Notice to Employer, the maximum amount of the aggregate disposable earnings of a person for any work week subject to garnishment to enforce any order for support may not exceed fifty percent (50%) of disposable earnings. Disposable earnings are that part of the earnings of any person remaining after the deductions for income taxes, Social Security, union dues and health coverage if all of the employee’s minor children are covered under such policy.
