A new business not in operation as of Aug. 2, 2010 cannot open for business until a medical marijuana business license is issued (B.R.C. 6-14-3(a)). While the city will try to issue licenses before Nov. 30, it may by Nov. 30 before the city can process all of the applications submitted. The city cannot issue licenses as applications are reviewed because the issuance of licenses is dependent on the location and saturation of existing legal businesses that have priority over new businesses. Q: My tenants cannot apply for a sales tax license until City Council amends how the distance is measured. Will their MMB license be automatically rejected if they apply before applying for a sales tax license? A: Yes. The applicant cannot apply for a license unless the proposed business can meet all of the requirements of the B.R.C., as the law exists on the date of the application.
