Must a Letter of Intent be filed if it is believed that the proposed project does not require CON review/approval?
No. However, as a safeguard, the Department recommends that a Letter of Intent be filed as a means of avoiding any CON-related compliance issues in the future. In accordance with CON Administrative Rule 325.9201, the Department will issue a determination whether the proposed project requires a Certificate of Need.
