More importantly, as schools work term time only and or part time – legally is it acceptable; that they are paid pro-rata on the £95.01?
Since £95 is a weekly minimum, there may not be need to prorate the amount in cases where the staff is working full time on weekly basis during term time (not sure if you would want to continue paying them during holidays and if so you may wish to agree an amount acceptable to both parties). However where the staff is working few days or hours in a week, it would be necessary to pay them pro-rata on this rate as it is based on full time work. Q) I know the national minimum pay increases from the age of 22 years; and am concerned that if we are paying apprentices on the national minimum in schools on £95.01 that we may be in line for complaints etc., A) Generally, minimum wage rules do not apply to all stages of an apprenticeship. So as long as the staff is still on an apprenticeship contract and are not paid less that £95/week, s/he cannot complain unless on the grounds of discrimination or any other unfairness grounds, even s/he is above 22 years.
