May a vendor conduct a follow-up survey using any or all of the sample members provided to them for the 2011 MA & PDP CAHPS Survey?
As outlined in the CMS Data Use Agreement that approved survey vendors signed, use of 2011 MA & PDP CAHPS sample members’ addresses and/or any other information provided by CMS or derived from the approved survey to collect information not approved by OMB is prohibited. CMS researched this issue with its privacy office in response to an inquiry to conduct a follow-up survey using the sample provided for the 2011 MA & PDP CAHPS survey. The CMS Privacy Office has ruled that because the data collection protocol and specific survey instruments used in 2011 MA & PDP CAHPS survey received official clearance from the Office of Management and Budget (OMB) under the Paperwork Reduction Act of 1995, as specified in each of the MA & PD survey forms, additional surveys using any or all of the same sample members drawn for the purpose of conducting the 2011 MA & PDP CAHPS survey would NOT be covered under the same OMB approval and therefore would be in violation of the Privacy Act.
