May a PEO Client Maintain an Outside Plan?
If drafted appropriately, a PEO client may maintain a plan outside of the PEO. The plan must meet IRS guidelines for minimum coverage and there may be special testing and reporting requirements. Please contact the Compliance and Technical Support Department at Executive Benefit Plans for additional information. We have many years of experience developing plans for the client companies of PEOs. We’ve established defined benefit plans for PEO clients who participate in the PEO’s multiple employer plan. Please contact us if you have an interest in establishing a plan outside a PEO’s plan.
