Liens, what are they and how do they affect a property?
There are different kinds of liens, but one of the most common is a mechanic’s or construction lien. This type of lien is put into place when the property owner owes money for materials or labor which improved the property in some way. This includes among other things, repairs, maintenance, new construction, landscaping and renovation. When purchasing real estate, it is important to make sure there is no lien on the property. If there is you will not be able to obtain a clear title. A title search will usually indicate whether or not a lien exists. It should also indicate the details regarding a lien or other encumbrances against the title. Searching the title is one of the services provided by your lawyer.
