Lasting Power of Attorney What is an ‘Lasting Power of Attorney’?
A Lasting Power of Attorney is a legal document (a specific legal form) which appoints somebody to look after your financial affairs and/or personal welfare affairs. Subject to a registration procedure with the Office of the Public Guardian, both Lasting Powers of Attorney documents will be able to continue to be valid even if you become mentally incapable of dealing with your affairs. The personal welfare Power of Attorney can only be used when the donor has lost mental capacity to make decisions for themselves. A property & affairs Lasting Power of Attorney can be used prior to the lost of mental capacity if you became physically frail.
