Yes, they will find out it’s “jailbroken” because there will be software installed where there shouldn’t be. They won’t fix it if they found out you lied to them. They shouldn’t even touch it because it’s not under warranty anymore. Apple isn’t going to say “oh well, a dud – here’s a new one!” No. When you send something like that in to get repaired, the very first step they take is to find out what went wrong. They pick apart EVERYTHING. They do this to obviously fix what needs fixing, but to also look for problems that could affect all iPods. Those iPods went through rigorous testing and QA before they were ever made public. If things are failing for consumers, they take it very seriously. Read the conditions of warranties. They don’t guarantee you a repair or replacement. The only way you will be approved for a repair or replacement is if they identified the problem as a screw-up on the company’s part.
