From 14 September 2009, all sponsors of subclass 457 visa holders (457 sponsors) are required to adhere to the Sponsorship Obligations. This includes the obligation to ensure equivalent terms and conditions of employment, which means that from 14 September 2009, all sponsors must pay their overseas workers market salary rates. However, for those subclass 457 visa holders who held a visa as of 14 September 2009, transitional arrangements will apply. Where there is an equivalent Australian in the workplace, the market salary rate is determined by the industrial arrangements that apply to that worker. The subclass 457 visa holder must be provided the same terms and conditions that are provided to the equivalent Australian worker. Detailed information on these arrangements, including transitional arrangements for subclass 457 visa holders whose visas were granted before 14 September 2009, is available on the department’s website.
