Isn it wrong to put a minority groups fundamental rights to a popular vote?
Yes. As Thomas Jefferson put it, “A democracy is nothing more than mob rule, where fifty-one percent of the people may take away the rights of the other forty-nine.” However, that is what happened with Proposition 8, and the California Supreme Court has left us with no alternative if we want everyone to be treated equally under the law once again. The only way we can restore the right of same-sex couples to marry is by passing a new ballot initiative.
