After carefully researching this concern, PEBP determined that eliminating neurotherapy and psychotherapy services for ADD and ADHD is not in violation of the recently amended (October 2008) Mental Health and Addiction Parity Act. The Act requires a group health plan that currently provides benefits for mental health, must provide the same level benefits for mental health issues as it does for other medical conditions. That is, the same deductible, copayments and coinsurance requirements as well as frequency maximums and life time maximum benefit. These changes go into effect as of the first plan year beginning on or after October 4, 2009, so in PEBP’s case this would take effect for the July 1, 2010 plan year.
