Is writing post-dated prescriptions legal?

My daughter has a painful chronic condition and has been declared disabled. Her doctor repeatedly prescribes narcotic medication, though every time she sees him she asks him to try a different drug which is specific for her condition because she does not want to continue taking narcotics. He refuses to change her prescribed treatment. She sees this doctor only once every six weeks, at which time he gives her two prescriptions for narcotic medication. Each prescription is for a three-week supply. He dates one prescription with the current date and gives her a duplicate prescription dated three weeks in advance. Is this legal and in compliance with DEA rules? I am under the impression that a doctor must see a patient at the time a prescription is written. Thank you.
