We are in unchartered waters with the number of bank foreclosures occurring at this time. While deficiency judgement is certainly a possibility, I believe that it remains to be seen what avenues the banks will pursue on a consistent basis. One way of avoiding a deficiency default judgement is to have a forgiveness clause written into an addendum to the purchase agreement.
