Is wage withholding or garnishment available for payment of child support?
A number of years ago, the law in New Mexico was changed to make wage withholding available in all child support cases. Prior to this change in the law, a party who was required to pay child support, would first have to accrue a delinquency before the court would order wage withholding. Now, wage withholding may begin immediately, and is processed by the New Mexico Child Support Enforcement Division in Santa Fe.
