Is there any way around the compulsory 38 hour week for Property Management employees, without having to work out time off in lieu, or paying overtime?
A. Yes. If an employee is guaranteed an income in excess of 125% of the Award rate for a Property Manager, they may apply to “opt out” of the provisions of Stage 1 of the Award. “Hours of Work” is one such provision. In other words, if a Property Management employee is guaranteed to earn in excess of 125% of the Award during the next year, they may “opt out” of “Hours of Work”, using Schedule 1 to the Award to make the application.
