Is there any time limit on materials used under Fair Use?
Yes. Clearly, the monetary effect of the use of copyrighted material is critical. The fourth Fair Use Factor, Market Effect, and the classroom guidelines are directly related to whether a use of copyrighted materials deprives the owner of income. Therefore, long term use of copyrighted materials fall outside of Fair Use and negatively impact the cumulative effect. One time use of copyrighted materials qualifying under the Four Factors will always be a Fair Use. A second time might be Fair Use. Fair Use is “stretched” when a third time is used and can begin to be considered outside of the Four Factors of Fair Use.
