It is doubtful that any government in Canada will legalize cannabis. A more likely outcome would be its decriminalization. The Green Party and NDP of both support decriminalization. The Liberals introduced legislation twice to decriminalize simple possession. In both cases (2003 and 2004) the bill died when elections were called. Finally, there have been a number of court cases, with mixed results. These are based primarily on Charter rights surrounding the availability of supply for medical purposes. The Ontario Superior court in 2008 overturned a lower court decision that there currently are no possession laws. It is unclear whether this will be appealed.
