A As per Section 129 D of the Customs Act, 1962 the Central Board of Excise and Customs may of its own motion examine the order passed by the Commissioner of Customs and may pass such orders directing the Commissioner to apply to the Appellate Tribunal for the determination of such points arising out of the decision or order as may be specified by the Board in its order. Similarly, the Commissioner of Customs may of his own motion examine any decision or order passed by an Adjudicating Authority sub-ordinate to him and pass an order directing such Authority to apply to the Commissioner (Appeals) for the determination of such points arising out of the decision or Order as may be specified by the Commissioner of Customs in his Order. The Board or the Commissioner as the case may be before the expiry of one year shall make such order from the date of the decision or order of the Adjudicating Authority.
