Is there any law against selling public domain items downloaded from the web on eBay?
Answer There is, so far as I know, no rule against selling public domain information downloaded from the web. However, this is a grey area where a lot of sellers make many mistakes. As an example, just because you can download something free from the web doesn’t mean you can then sell it. Many people feel that just because something is AVAILABLE on the net that it is ‘public domain’ which can’t be further from the truth. What some sellers have done is to collect together free information (note I say Information and not software) into a CD and then sell the manufacture of the CD. They are careful to point out that all the contained information has it’s own rights and that the seller is merely selling a collection of free items. THey do not claim copyright. Software is a whole new area of copyright and you had best be sure of this before you sell one.
