Is there any consensus amongst conveyancing solicitors as to whether or not a flying freehold is a major issue?
No. If you look over the web you will see some solicitors state that flying freeholds are not a problem and other solicitors will state that you should stay well clear of flying freeholds. Ultimately, the decision should not be down to the conveyancing lawyer. The conveyancing lawyer’s job is to present the facts and issues to you and (indeed if you are obtaining a mortgage) to your lender. Sure, a conveyancing lawyer can advise you what you should do in their opinion but ultimately the decision is down to you and (if applicable) your lender.
