Is there an appeal process for a variance or exception request that is denied?
The Architectural Review Committee’s denial of a variance or exception request does not mean that you cannot seek an appeal and should be provided information as to what the appeal process is. An owner is given a form explaining that a variance/exception appeal can be made to the ARC if new or different convincing arguments/evidence can be furnished. An owner should be provided specific reasons why the variance/exception request was denied and advised of potential changes that could be made to bring the requested issue into a permit-able situation at the variance/exception appeal hearing.
