Yes. Time limits for filing claims are called statues of limitations. In Massachusetts, employment discrimination claims must be filed with the Massachusetts Commission Against Discrimination (MCAD) and/or the federal Equal Employment Opportunity Commission (EEOC) prior to you filing a complaint with a court of law. You must file your claim of discrimination with the MCAD within 300 days of the unlawful practice you are complaining about. For example, if you are complaining about being demoted then you must file within 300 days of you being notified of your demotion.There is a 180 day period to file claims with the EEOC, although claims filed within the 300 day limit at the MCAD that are ‘dually filed’ with the EEOC are considered timely in Massachusetts. Also, you must file your claim in a court of law within three years of the unlawful practice you are complaining about. If you do not file your claim within the required time period you will lose your right to file your claim forever.
