Is there a state agency that regulates homeowners associations?
No. Although the Department of Community Affairs has statutory authority in the area of reviving expired homeowners association covenants, it does not regulate homeowners’ associations, nor does any other state agency. Condominium and Cooperative Associations are regulated by the Department of Business and Professional Regulation, as are Mobile Home Parks. The Department of Business and Professional Regulation also provides a Condominium Ombudsman to help condominium and cooperative residents with problems. Individuals who are employed as Community Association Managers are licensed by the Department of Business and Professional Regulation. However, there is no state agency that regulates the homeowners’ associations themselves, nor is there an ombudsman for problems related to homeowners’ associations.
